Could This be The Death of Habeas Corpus: Who is Killing the Great Writ?


Could this be the death of habeas corpus a document honored since the thirteenth century?

The Great Writ, as the writ of habeas corpus is fondly called by many, has been protecting people from abusive military regimes for centuries and now it seems our own government has managed to shred it to pieces.

The Bush administration demonstrated very dramatically how easy it is for a President to misuse and abuse the Great Writ.

The actions taken by George Bush, and supported by Congress, to diminish and possibly destroy the right of citizens and non citizens to petition for a fair trial against military imprisonment have all of us asking, could this be the death of habeas corpus?

With no solid and trusted protection in place to submit a petition to the court system or to have a friend or family member or associate submit a petition for you leaves everyone vulnerable to a fascist military regime.

The people at Guantanamo are still imprisoned there and although action appears to be taken to release them, they are still at risk until actually released.

They are there without any formal charges against them and they have been tortured and watched others be tortured while they are behind prison walls.

Most and possibly all of these people imprisoned are innocent.

The very same treatment can happen to any of us as we keep getting monitored and spied upon and should it happen will we be able to file a writ and have our day in a non military court system?



Military Commission Act of 2006 and Out of Control Presidential Power

America was hit harder than what hit the buildings on 9/11 for Americans were hit with the force of Presidential power gone out of control and no one was asking at that time could this be the death of habeas corpus and of the Constitution and of the Republic.

Most Americans were in shock and grieving for the families and the people that had lost their lives. Most Americans were grieving but not all.

Those in the highest offices of the United States were ready to jump right in on the biggest campaign ever.

That campaign was how to wrap up the death of America and the Constitution that protects Americans.

The people are supposed to vote on important laws and the people are supposed to vote on changes in the roles and functions of agencies and no one is supposed to touch the Constitution.

The Constitution states that the privilege of habeas corpus shall not be suspended except in cases of rebellion or invasion when the public safety may require it.

The Constitution does not give a President permission to issue a law blocking habeas corpus and it does not give the President the power to change the meaning or context of habeas corpus.

Presidential power that is unconstitutional and out of control, could this be the death of habeas corpus and the United States as a free republic?
