In today’s ever changing world, Habeas Corpus and terrorism are two concepts that clearly illustrate how an attack on civil liberties is taking place.
Our government, intent on stripping Americans of their rights, have successfully eviscerated the Constitution.
Terrorism can be defined as the systematic employment of violence or intimidation to coerce a government or community into acceding to specific political demands over an extended period of time.
Habeas corpus is the protection of an individual against unlawful detention and guarantees an incarcerated person the right to stand before an impartial court in reasonable time to defend the charges against them.
Today, in a sense, one could say that Habeas Corpus and terrorism as concepts are struggling against each other to take over the minds of the free people of the world.
Since the attacks of 9/11 America has led a global war on terrorism and in that time, the right to habeas corpus has been the most important casualty.
Terrorism is the justification for the creation of the Military Commissions Act, which was passed into law in 2006 and grants the U.S. government sweeping rights to detain any person they deem to be a threat to the national interest.
Consider that at the same time as this law was drafted and passed, terrorism was used as the reason to keep the people of America in a state of suspicion and fear.
When the people are afraid, many will unquestioningly accept a removal of certain civil liberties including the right to habeas corpus.
Make no mistake, however, that without the right to habeas corpus, no other right or freedom can truly exist because they can be removed in an instant with indefinite incarceration.
True Terrorism Can Come in Many Forms
When considering the definition of terrorism, look at the blatant disregard for constitutional rights of the people that has been displayed in recent years by the U.S. government.
It can be argued that with the Foreign Intelligence Surveillance Act, the law that goes against the Fourth Amendment rights of the people to be protected against unreasonable search and seizure, you could determine that the government is inflicting a form of terrorism upon its people.
When people live in fear that at any time they might be taken into custody by the State and detained indefinitely with no right to hear the charges, this could be considered terrorism.
An American citizen of Iranian descent might feel this systematic intimidation every day of their lives in present day America.
Therefore, habeas corpus and terrorism together form the basis for a battle to restore the right for all citizens regardless of background to enjoy freedom and civil liberties as they were designed in the Constitution.
Finding the Root Causes of Terror
There is no doubt that terrorism, as defined in recent years, does exist. There are tyrannical people in foreign nations bent on doing harm to the people of free countries.
However, habeas corpus and terrorism go hand in hand in this respect.
With each person unlawfully detained without charge in a foreign land and held indefinitely and under duress, others feel hatred burning deeper within themselves.
For a country to prove it respects freedom, it must adhere to the principles of free people and be above the enemy it faces.
It is the golden rule that can be applied in all circumstances, and has been forgotten in the United States. Terrorism can exist in the dusty deserts of Afghanistan or in the backrooms of Washington.
Until the rights of Habeas Corpus are restored, the banking mafia systematically employing that terror will never be easily defined.
